1. 接受條款
你使用古脈今聲,即表示你同意受本條款約束。若你不同意,請停止使用本服務。
2. 服務內容
本服務提供古文文本管理、解析與 AI 輔助翻譯功能。功能可能隨時更新、調整或下線。
3. 使用資格
你必須年滿 13 歲方可使用本服務。若你未滿所在司法管轄區之成年年齡但已滿 13 歲,你確認已取得父母或監護人同意使用本服務。本服務並非以兒童為主要對象——詳見隱私政策。
4. 帳戶與安全
- 你需提供有效帳戶資訊並妥善保管登入憑證。
- 你對帳戶下發生的活動負責。
- 若發現未授權使用,請立即聯絡我們。
5. 內容、智慧財產與你的聲明保證
- 你保留你提交內容的權利;你需確保有合法使用權,包括對他人拍攝、掃描或轉錄的文獻,以及文獻中提及之第三方(如親屬)個人資訊的處理。
- 你聲明並保證:你提交的內容不會侵害任何第三方之著作權、隱私權或其他權利,且你有合理權利上傳、處理並使用該內容。
- 你授權我們於提供服務所必要範圍內處理、儲存、傳輸你的內容(包括傳送至第三方 AI 供應商進行辨識/翻譯,詳見隱私政策)。
- App 本身之程式、介面與品牌屬 DaoGrove Labs 或授權方所有。
- 若你認為 App 內建文庫或其他內容侵害你的著作權,請透過支援頁面與我們聯絡,我們會調查並在合理情況下移除相關內容。本服務目前不提供公開發布或分享功能,你的內容不會公開展示予其他使用者。
6. 使用規範
你同意不會:
- 違反任何適用法律或第三方權利。
- 上傳或傳送非法、侵權、惡意或有害內容。
- 嘗試干擾、攻擊、逆向或濫用本服務與基礎設施。
- 繞過配額、訂閱或技術限制。
7. AI 功能聲明
使用「拍照辨識古文」功能,即表示你同意你提交的相片將由 OpenRouter AI 進行即時文字辨識處理。相片於辨識完成後不會保留於我們或 OpenRouter 的伺服器。
8. 訂閱、配額與付款
- 不同方案提供不同字數配額與功能(免費版、標準版、研究版)。
- 你同意依當時顯示之價格與規則支付費用(如適用)。所有購買透過 Apple ID 收費,我們不會看到或儲存你的付款卡資料。
- 訂閱將自動續訂,除非在當期結束前至少 24 小時取消。你可透過「設定 > [你的名稱] > 訂閱項目」管理或取消。
- 我們可在合理通知後調整方案、配額或價格。
退款
App Store 購買之退款由 Apple 直接處理,我們沒有技術能力直接退款。請至 reportaproblem.apple.com 申請退款。為協助 Apple 處理退款請求,我們可能與 Apple 分享有限的購買與使用資料(「消耗資料」);使用本服務之購買功能即表示你同意此資料分享。
9. 服務可用性與變更
我們會盡力維持服務可用,但不保證服務不中斷、無錯誤或永久可用。
10. 免責與責任限制
- 本服務按「現況」與「可用」提供,不作任何明示或默示擔保。
- 在法律允許範圍內,我們不對任何間接、附帶、特別或衍生損害負責。
- 在法律允許範圍內,我們的總責任以你於爭議發生前 12 個月內向我們支付的金額為上限;若你未付費,責任上限為 US $50。
11. 賠償
你同意就因你違反本條款、濫用本服務,或你提交之內容侵害第三方權利而引起的任何索賠、損害、責任與費用(含合理律師費),使 DaoGrove Labs 免受損害,惟因 DaoGrove Labs 自身違反法律或本條款所致者不在此限。
12. 終止
若你違反條款或有風險行為,我們可暫停或終止你對服務的存取。
13. 條款修改
我們可不時更新本條款。更新後版本公布即生效;你繼續使用即視為接受。
14. 爭議解決、仲裁與集體訴訟棄權
請仔細閱讀本條——它涉及你的法律權利,並要求大多數爭議須以個別仲裁方式解決,而非透過法院訴訟。
14.1 先行非正式協商
在提出任何索賠前,你同意先透過第 18 條之聯絡方式與我們協商,嘗試以非正式方式解決爭議,期間至少 30 天。多數疑慮可透過此方式解決。
14.2 具約束力之仲裁
若非正式協商未能解決爭議,你與 DaoGrove Labs 同意:任何因本條款或本服務所生之爭議,將透過美國仲裁協會(AAA)依其消費者仲裁規則進行具約束力之個別仲裁解決,而非透過法院訴訟;惟任何一方仍可選擇於符合資格時,改於小額索償法院提出個別訴求。
14.3 集體訴訟棄權
你與 DaoGrove Labs 同意,爭議僅得以個人身份提出,不得作為任何集體、合併或代表性訴訟之原告或成員。仲裁人不得合併一人以上之請求,亦不得以任何形式主持代表性或集體程序。
14.4 你退出仲裁協議的權利
你可於首次接受本條款後 30 天內,以主旨「Arbitration Opt-Out」寄送電子郵件至第 18 條所列地址,並附上你的帳戶電子郵件,選擇退出本仲裁協議(僅限第 14.2–14.3 條,本條款其餘部分仍然適用)。退出仲裁不影響你與 DaoGrove Labs 之其他關係。
14.5 準據法
本條款受加州法律管轄,不適用其法律衝突原則,惟第 14 條(仲裁)適用《聯邦仲裁法》。就任何不屬仲裁範圍(或仲裁協議經認定不可執行)之爭議,你與 DaoGrove Labs 同意由加州之州法院及聯邦法院專屬管轄。
15. 出口合規
你不得於美國法律及取得本 App 所在司法管轄區法律授權範圍之外使用或出口本 App。你聲明你目前並非位於受美國政府禁運或經美國政府認定為「支持恐怖主義」之國家,且未被列於美國政府之任何禁止或限制交易對象名單。
16. App Store 附加條款
若你透過 Apple App Store 下載並使用本 App,以下條款額外適用:
- Apple 對本 App 並無提供任何維護或支援服務之義務;維護與支援完全由我們(DaoGrove Labs)負責。
- 若本 App 未能符合任何適用之保固,你可通知 Apple,Apple 將退還你為該 App 所支付之購買價金(如有);在法律允許之最大範圍內,Apple 對該 App 不承擔其他任何保固責任,而此類保固責任之其他索賠、損失、責任、損害、成本或費用,將完全由我們負責。
- 對於任何第三方就本 App 或你對其之持有或使用而提出之主張,包括但不限於:(a) 產品責任主張、(b) 本 App 不符合任何適用法律或法規要求之主張,以及 (c) 因消費者保護、隱私或類似法規所生之主張,我們(而非 Apple)將負責處理該等主張之調查、抗辯、和解及免責。
- 若第三方主張本 App 或你對其之持有與使用侵害該第三方之智慧財產權,我們(而非 Apple)將負責就此類智慧財產權侵權主張進行調查、抗辯、和解及免責。
- Apple 與其子公司為本條款之第三方受益人,於你接受本條款後,Apple 將有權(並將被視為已接受該權利)以第三方受益人之身分對你執行本條款。

17. 一般條款
若本條款任何條文經認定無法執行,其餘條文仍然完全有效。我們未行使任何權利或條款,不構成對該權利之棄權。本條款與我們的隱私政策構成你與 DaoGrove Labs 之間關於本 App 的完整協議。

Gumai Jinsheng Terms of Service
Operator: DaoGrove Labs ("we," "our," "us")
1. Acceptance
By using Gumai Jinsheng, you agree to these Terms. If you do not agree, do not use the Service.
2. Service Description
The Service provides Classical Chinese text management, parsing, and AI-assisted translation features. Features may change, be updated, or discontinued.
3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you confirm you have a parent or guardian's permission to use the Service. The Service is not directed at children — see our Privacy Policy.
4. Accounts and Security
- You must provide valid account information and keep credentials secure.
- You are responsible for activity under your account.
- Contact us immediately if you suspect unauthorized access.
5. Content, Intellectual Property, and Your Warranties
- You retain rights to your submitted content and must have the legal right to use it — including documents you photograph, scan, or transcribe that belong to someone else, and any third-party personal information (e.g., relatives named in a family document) contained within it.
- You represent and warrant that your submitted content does not infringe any third party's copyright, privacy, or other rights, and that you have a reasonable basis for uploading, processing, and using it.
- You grant us permission to process, store, and transmit content as needed to provide the Service (including sending it to third-party AI providers for recognition/translation — see our Privacy Policy).
- The app software, UI, and branding are owned by DaoGrove Labs or its licensors.
- If you believe the app's built-in library or other content infringes your copyright, contact us via the Support page and we'll investigate and remove it where appropriate. The Service currently has no public posting or sharing feature, so your content is never displayed to other users.
6. Acceptable Use
You agree not to:
- Violate applicable laws or third-party rights.
- Upload or transmit unlawful, infringing, malicious, or harmful content.
- Interfere with, attack, reverse-engineer, or abuse the Service.
- Bypass quota, subscription, or technical limitations.
7. AI Features Disclaimer
By using the Photo Recognition feature, you consent to your submitted photos being processed by OpenRouter AI for text extraction. Photos are not retained after processing.
8. Subscription, Quotas, and Payments
- Different plans (Free, Standard 標準版, Research 研究版) include different character quotas and features.
- You agree to pay fees shown at the time of purchase, where applicable. All purchases are billed to your Apple ID — we don't see or store your card details.
- Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. Manage or cancel anytime via Settings > [your name] > Subscriptions.
- We may update plans, quotas, or pricing with reasonable notice.
Refunds
Refunds for App Store purchases are issued by Apple, not by us — we don't have the technical ability to refund a purchase directly. Request one at reportaproblem.apple.com. To help Apple resolve refund requests, we may share limited purchase/usage data ("consumption data") with Apple; using the Service's purchase features means you consent to that sharing.
9. Availability and Changes
We strive for reliability but do not guarantee uninterrupted, error-free, or permanent availability.
10. Disclaimers and Limitation of Liability
- The Service is provided "as is" and "as available" without warranties.
- To the maximum extent allowed by law, we are not liable for indirect, incidental, special, or consequential damages.
- To the maximum extent allowed by law, our total liability is capped at the amount you paid us in the 12 months before the claim; if you paid nothing, the cap is US $50.
11. Indemnification
You agree to indemnify and hold DaoGrove Labs harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Service, or content you submit that infringes a third party's rights — except to the extent caused by DaoGrove Labs' own violation of law or these Terms.
12. Termination
We may suspend or terminate access if you violate these Terms or create risk to the Service.
13. Changes to Terms
We may update these Terms from time to time. Updated terms are effective when posted. Continued use means acceptance.
14. Dispute Resolution, Arbitration, and Class Action Waiver
Please read this section carefully — it affects your legal rights and requires most disputes to be resolved by individual arbitration rather than in court.
14.1 Informal Resolution First
Before filing any claim, you agree to contact us at the address in Section 18 and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way.
14.2 Binding Arbitration
If informal resolution doesn't work, you and DaoGrove Labs agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court instead if it qualifies.
14.3 Class Action Waiver
You and DaoGrove Labs agree that disputes will be brought only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
14.4 Your Right to Opt Out
You may opt out of this arbitration agreement (Sections 14.2–14.3 only — the rest of these Terms still apply) by emailing us at the address in Section 18 within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account email address. Opting out does not affect any other part of your relationship with DaoGrove Labs.
14.5 Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 14 (Arbitration). For any dispute not subject to arbitration (or where the arbitration agreement is found unenforceable), you and DaoGrove Labs agree to the exclusive jurisdiction of the state and federal courts located in California.
15. Export Compliance
You may not use or export the Service except as authorized by U.S. law and the laws of the jurisdiction in which it was obtained. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
16. App Store Additional Terms
If you obtained this App through the Apple App Store, the following terms also apply:
- Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App; maintenance and support are solely our (DaoGrove Labs') responsibility.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our Privacy Policy, are the entire agreement between you and DaoGrove Labs regarding the App.
